BF TACKLE LEGAL NOTICE & PRODUCT TERMS

Welcome to BF Tackle. By accessing our website, purchasing our products, or using any BF Tackle product, you acknowledge and agree to the terms outlined in this Legal Notice.

BF Tackle reserves the right to modify these terms at any time. Updated terms will become effective when posted on our website.

1. INTELLECTUAL PROPERTY & PRODUCT DESIGNS

All BF Tackle products, designs, concepts, product names, logos, graphics, photographs, videos, written materials, packaging, marketing materials, and other original content are the property of BF Tackle or are used with permission.

This includes, but is not limited to:

  • Product designs and configurations

  • Hook designs and modifications

  • Weighting systems

  • Attachment and retention systems

  • Product concepts and innovations

  • Product names and branding

  • Logos and trademarks

  • Packaging and product presentation

  • Product photographs and videos

  • Website content

  • Marketing materials

  • Original drawings, diagrams, and technical information

No person or business may copy, reproduce, manufacture, sell, distribute, modify for commercial purposes, reverse engineer for commercial purposes, or create substantially similar products based on BF Tackle's proprietary designs without express written authorization from BF Tackle.

Purchasing a BF Tackle product does not transfer ownership of BF Tackle's intellectual property or grant permission to reproduce, manufacture, or commercially exploit the product or its design.

BF Tackle reserves all rights available under applicable intellectual-property laws and may pursue legal remedies against unauthorized copying, manufacturing, distribution, or commercial use.

2. PRODUCT PHOTOGRAPHS, VIDEOS & CONTENT

All original photographs, videos, graphics, product descriptions, written content, and other media created by BF Tackle are protected by applicable copyright and intellectual-property laws.

You may not reproduce, copy, download, modify, publish, sell, distribute, or commercially use BF Tackle content without prior written permission.

Unauthorized use of BF Tackle content may result in removal requests, account or order restrictions, and/or legal action where appropriate.

3. LEAD & OTHER MATERIALS

Certain BF Tackle products may contain lead or other materials that require appropriate handling and use.

Lead may be present in weights, weighted hooks, fishing tackle, or other products manufactured or sold by BF Tackle.

Customers are responsible for using these products appropriately and in accordance with all applicable federal, state, and local laws and regulations.

Customers should:

  • Keep products containing lead away from children and pets.

  • Do not intentionally ingest, chew, or place products in the mouth.

  • Wash hands after handling products containing lead, particularly before eating, drinking, or smoking.

  • Follow applicable safety instructions and warnings.

  • Store products appropriately when not in use.

  • Dispose of damaged or unwanted products in accordance with applicable local requirements.

Do not modify, melt, burn, grind, sand, or otherwise alter lead-containing components unless you are properly equipped and understand the applicable safety requirements.

Customers are responsible for determining whether the purchase, possession, use, transportation, modification, or disposal of a product complies with laws applicable to them.

4. FISHING & OUTDOOR ACTIVITY RISKS

Fishing and outdoor activities involve inherent risks, including but not limited to:

  • Fish hooks and sharp components

  • Sharp or pointed tackle

  • Treble hooks and other hooks

  • Lead and other materials

  • Casting-related injuries

  • Line breakage

  • Tackle failure

  • Slipping and falling

  • Drowning

  • Watercraft-related hazards

  • Weather and environmental conditions

  • Wildlife

  • Property damage or personal injury

BF Tackle products are intended to be used as fishing equipment. Users are responsible for exercising appropriate caution and following safe fishing practices.

Never cast, handle, or use fishing tackle in a manner that could reasonably cause injury to yourself or another person.

5. PRODUCT MODIFICATION

Modifying, altering, repairing, disassembling, or combining a BF Tackle product with another product may change its performance and safety characteristics.

BF Tackle is not responsible for damage, injury, or loss resulting from unauthorized modifications or alterations to our products.

Any modification performed by a customer or third party is performed at the user's own risk.

6. PRODUCT USE

BF Tackle products must be used for their intended purpose and in accordance with any instructions, warnings, or recommendations provided by BF Tackle.

Customers are responsible for determining whether a particular product is appropriate for their fishing conditions, equipment, target species, and intended use.

BF Tackle does not guarantee that a product will perform identically under every fishing condition or with every combination of equipment.

7. AGE & SUPERVISION

BF Tackle products may contain sharp hooks, small components, weights, and other materials that can present hazards.

Children should only use BF Tackle products under appropriate adult supervision.

Products should be stored in a secure location when not in use.

8. WARRANTIES & PRODUCT CONDITION

Except where expressly stated otherwise in writing, BF Tackle products are provided subject to the applicable warranties, if any, described on the product page, packaging, or accompanying documentation.

BF Tackle does not warrant that every product will meet every user's particular expectations, fishing conditions, or intended application.

Normal wear and tear, misuse, abuse, improper storage, unauthorized modification, accidental damage, and damage caused by improper use may not be covered by any applicable warranty.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, BF Tackle and its owners, employees, representatives, affiliates, and suppliers shall not be responsible for indirect, incidental, consequential, special, or punitive damages arising from the purchase, possession, modification, or use of BF Tackle products.

This includes, where permitted by law, claims involving property damage, personal injury, loss of use, lost profits, or other consequential losses.

Nothing in this notice is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

10. CUSTOMER RESPONSIBILITY

Customers are responsible for:

  • Using products appropriately.

  • Following product warnings and instructions.

  • Inspecting products before use.

  • Replacing damaged or worn equipment.

  • Maintaining safe distances from other people while casting.

  • Complying with applicable fishing laws and regulations.

  • Complying with applicable environmental and material-handling laws.

  • Determining whether a product is appropriate for their intended use.

BF Tackle is not responsible for a customer's failure to follow applicable laws, safety practices, warnings, or instructions.

11. COPYING & COMPETITOR PRODUCTS

BF Tackle takes its product development and intellectual property seriously.

The unauthorized copying, reproduction, manufacture, sale, or distribution of products that incorporate BF Tackle's protected designs, proprietary features, branding, artwork, or other protected intellectual property may constitute infringement or other unlawful conduct.

BF Tackle reserves the right to investigate suspected infringement and take any lawful action it determines appropriate, including requesting removal of infringing materials, contacting platforms or manufacturers, pursuing available administrative remedies, and pursuing legal claims where appropriate.

12. TRADEMARKS & BRANDING

BF Tackle names, logos, product names, slogans, graphics, and other brand identifiers may constitute trademarks, trade names, or other protected intellectual property.

No permission is granted to use BF Tackle branding in a manner that suggests sponsorship, affiliation, endorsement, partnership, or authorization without prior written consent.

13. THIRD-PARTY PRODUCTS

BF Tackle may sell, recommend, or reference products manufactured by third parties.

BF Tackle is not responsible for the design, manufacture, warnings, instructions, or performance of third-party products except to the extent required by applicable law.

Customers should review the manufacturer's instructions and warnings before using third-party products.

14. WEBSITE CONTENT & INFORMATION

BF Tackle attempts to provide accurate product descriptions, specifications, photographs, and other information. However, product specifications, availability, packaging, colors, and designs may change without notice.

Photographs may not perfectly represent the actual appearance of a product.

BF Tackle reserves the right to correct errors, update information, discontinue products, and modify product specifications without prior notice.

15. COMPLIANCE WITH LAWS

Customers are responsible for complying with all applicable federal, state, and local laws and regulations relating to the purchase, possession, transportation, use, modification, and disposal of BF Tackle products.

Fishing regulations vary by jurisdiction. Customers are responsible for knowing and following the regulations applicable to their location.

16. SEVERABILITY

If any provision of this Legal Notice is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue to apply to the fullest extent permitted by law.

17. NO WAIVER

BF Tackle's failure to enforce any provision of this Legal Notice does not constitute a waiver of BF Tackle's right to enforce that provision in the future.

18. GOVERNING LAW

To the extent permitted by applicable law, this Legal Notice and disputes arising from the purchase or use of BF Tackle products shall be governed by the laws applicable in the jurisdiction designated by BF Tackle's applicable terms of sale, without regard to conflict-of-law principles.
